1. Purpose
These Terms and Conditions govern access to and use of the Crazy Arbor Tree Care brand website, hereinafter referred to as the “Website”, as well as the general conditions applicable to enquiries, quotation requests, technical visits and the contracting of services advertised through the Website.
By accessing or using this Website, the user confirms that they have read, understood and accepted these Terms and Conditions.
If the user does not agree with any of the provisions contained in this document, they must refrain from using the Website.
The contracting of a service may also be subject to the specific conditions set out in the relevant quotation, commercial proposal, work order or contract.

The Website may also allow the user to:

- request a quotation;
- request a technical site visit;
- submit photographs or information relating to trees, land or proposed work sites;
- request contact regarding urgent interventions;
- learn about the services and areas of work covered by Crazy Arbor Tree Care;
- contact the team directly through a form, telephone, email or other available platforms.
Unless expressly stated otherwise, the Website is not an e-commerce platform, and submitting a form does not automatically create a contract for the provision of services.
4. Services
The services advertised by Crazy Arbor Tree Care may include, among others:

The availability of each service depends on the location, access conditions, technical assessment, equipment and resources required, weather conditions, applicable permissions and acceptance of the relevant quotation.
5. Use of the Website
The user agrees to use the Website responsibly, diligently and in accordance with applicable law.
In particular, the user agrees not to:
- use the Website for unlawful or fraudulent purposes;
- provide false or misleading information;
- introduce viruses, malware or other malicious code;
- attempt to access restricted areas of the Website;
- compromise the security or stability of the computer systems;
- collect data relating to other users without authorisation;

7. Enquiries, Quotation Requests and Technical Visits
The forms available on the Website are intended for enquiries, quotation requests, the scheduling of technical visits or requests to be contacted.
Submitting a request:
- does not constitute acceptance of any work;
- does not create a contract for the provision of services;
- does not guarantee availability on a particular date;
- does not guarantee that the service will be carried out;
- does not automatically establish a price;
- does not oblige Crazy Arbor Tree Care to accept the proposed work.
After receiving a request, Crazy Arbor Tree Care may ask for photographs, videos, the location, approximate measurements, access information or other details required for a preliminary assessment of the work.
Any estimates based solely on photographs, videos or descriptions provided by the client are preliminary and may be amended following an on-site inspection.
Where necessary, a technical visit to the site may be proposed. If the visit is subject to a charge, the client will be informed before it takes place.
8. Quotations and Formation of the Contract
The quotation may specify, among other matters:
- the work included;
- the trees or areas covered;
- the proposed method of work;
- the technical resources required;
- whether green waste will be removed or left on site;
- any work expressly excluded;
- the price and applicable taxes;
- the payment terms;
- the period for which the quotation remains valid;
- the estimated date or period of completion;
- the specific conditions of the work.
Unless otherwise stated, the contract is deemed to have been formed when the client expressly accepts the quotation in writing or through another means capable of providing evidence and fulfils any initial conditions specified therein, including the payment of any deposit or confirmation fee.
Silence, failure to respond or the mere submission of a request through the Website does not constitute acceptance of a quotation.
In the event of any discrepancy between these Terms and the specific conditions contained in an accepted quotation, the specific conditions of the quotation shall prevail in relation to the contracted service, without prejudice to the client’s statutory consumer rights.
9. Technical Assessment and Changes to the Working Method
Arboriculture and tree work are subject to the conditions actually found on site, including the condition and stability of the tree, the presence of decay, cavities, damaged roots, leaning, tension within branches, obstacles and proximity to buildings, power lines, roads, walls or other structures.
Crazy Arbor Tree Care may adapt the originally proposed working method where this is necessary to protect people, animals, property, trees, equipment or workers.
Where a change involves additional work, significant costs or a substantial alteration to the contracted service, the client will be informed and must authorise the change whenever circumstances reasonably allow.
If conditions are identified that make the work unsafe, unlawful or technically inadvisable, Crazy Arbor Tree Care may suspend, postpone, modify or refuse the work.
10. Permissions and Licences
Certain pruning, felling or tree interventions may require permission from the local authority, permission from a condominium or property management body, the consent of the property owner, notification to public authorities or compliance with special rules relating to protected species, classified areas or public spaces.
Unless the quotation expressly states otherwise, the client is responsible for:
- confirming that they own the site or have permission to commission the work;
- obtaining the necessary licences, permissions or consents;
- informing Crazy Arbor Tree Care of any known restrictions;
- ensuring that the work does not infringe the rights of neighbouring owners, co-owners, condominiums or third parties.
Crazy Arbor Tree Care may request evidence of the applicable permissions and may refuse to begin or continue the work while doubts remain regarding its legality.
11. Prices and Payment Terms
The price of the service shall be the price stated in the quotation accepted by the client.
The quotation should identify the total amount, applicable taxes, payment terms and services included.
Prices may take into consideration, among other matters:
- the size and condition of the trees;
- the height and technical difficulty of the work;
- access conditions;
- the need for platforms, cranes, machinery or specialist equipment;
- the number of workers required;
- the level of risk involved;
- the volume and destination of the waste;
- travel and transport requirements;
- the need for signage or restrictions at the site;
- the urgency of the work.
Additional work not included in the original quotation will only be charged where it has been requested or authorised by the client, or where it results from unforeseen circumstances communicated during the performance of the work.
In situations involving immediate danger, Crazy Arbor Tree Care may take the minimum measures necessary to stop the work and leave the site in a safe condition.
Failure to comply with the payment terms may result in suspension of the work, postponement of the intervention or the application of any consequences permitted by law and previously communicated to the client.
12. Scheduling, Postponement and Cancellation
Dates provided for carrying out the work are estimates and may be changed for safety reasons, weather conditions, equipment unavailability, delays to previous work, the need to obtain permissions, emergency situations or other circumstances outside the reasonable control of Crazy Arbor Tree Care.
Work may be postponed or interrupted in the event of:
- strong winds;
- heavy rain;
- thunderstorms;
- fire risk;
- poor visibility;
- unstable ground conditions;
- unsafe conditions for working at height;
- people or animals being present within the safety zone;
- the site being inaccessible;
- an order or instruction from the competent authorities.
The client must provide as much notice as possible of any cancellation or requested change.
Where provided for in the quotation or communicated in advance, reasonable costs already incurred may be charged, including travel, equipment reservations, licences, machinery hire or team mobilisation costs, within the limits permitted by law.
If the team is unable to access the site on the agreed date for reasons attributable to the client, it may be necessary to reschedule the service and charge any previously communicated travel or mobilisation costs.
13. Statutory Right of Withdrawal
Where the client is a consumer and the contract is entered into at a distance or away from the business premises, the statutory right of withdrawal provided for in Portuguese Decree-Law No. 24/2014 of 14 February, as amended, may apply.
Where legally applicable, the consumer may withdraw from the contract without providing a reason within 14 calendar days, or within any different period expressly provided for by applicable law.
Where the consumer requests that the service begin during the withdrawal period, that request must be made expressly using a durable medium.
If the consumer exercises the right of withdrawal after requesting that the service begin, the consumer may be required to pay an amount proportionate to the work actually carried out up to the date of withdrawal, in accordance with the law.
Where the service has been fully performed with the consumer’s prior express consent and acknowledgement that the right of withdrawal will be lost once the service has been fully performed, that right may no longer apply.
Urgent interventions requested by the consumer may begin before the end of the withdrawal period where an express request has been made.
14. Client Responsibilities
The client agrees to:
- provide accurate, complete and up-to-date information;
- correctly identify the trees and areas covered by the work;
- disclose any unstable trees, broken branches, previous failures or other known risks;
- provide information about cables, pipes, irrigation systems, septic tanks, storage tanks, wells, swimming pools, buried structures or other existing infrastructure;
- ensure safe access to the site for people, vehicles, machinery and equipment;
- remove vehicles, furniture, fragile items and other property from the working area;
- keep children, visitors and animals away from the safety zone;
- inform neighbours, condominiums or third parties where they may be affected by the work;
- not interfere with workers, equipment or safety procedures;
- follow the safety instructions provided by the team.
Crazy Arbor Tree Care shall not be responsible for damage arising from the omission of relevant information, unidentified infrastructure or failure by the client or third parties to follow safety instructions.
15. Safety at the Work Site
Arboriculture work may involve working at height, cutting timber, the controlled lowering or falling of branches, and the use of chainsaws, machinery, ropes, platforms and other potentially hazardous equipment.
During the performance of the work, a safety zone may be established, access to which will be restricted to the team and expressly authorised persons.
The client, family members, employees, visitors, neighbours and animals must remain outside this area until advised otherwise.
Crazy Arbor Tree Care may immediately stop the work whenever the required safety conditions are not respected.
Where the work affects roads, pavements, public spaces, power lines or other infrastructure, the work may depend on the cooperation or authorisation of the competent authorities.
16. Hidden Conditions and Limitations of the Assessment
Trees are living organisms and may contain internal defects, decay, cavities, compromised roots, pests, diseases or weaknesses that are not visible during a standard external assessment.
Unless specialist examinations or tests have been contracted, Crazy Arbor Tree Care’s assessment will be based on visible conditions and the information available at the time of the visit or performance of the work.
A visual assessment does not guarantee the identification of all internal, underground or hidden defects.
Crazy Arbor Tree Care cannot guarantee that a tree will not subsequently lose branches, become diseased, die or fall as a result of natural events, weather conditions, changes to the soil, pests, diseases, subsequent construction work, third-party interventions or defects that could not reasonably be detected.
This provision does not exclude liability for acts or omissions attributable to Crazy Arbor Tree Care under applicable law.
17. Wildlife, Nests and Protected Species
Work may be suspended, postponed or modified where active nests, protected animals, colonies, sensitive habitats or other legally protected circumstances are identified.
Crazy Arbor Tree Care may recommend that the client contact the relevant authorities or organisations before the work continues.
Mobilisation, travel or work costs incurred before the suspension may remain payable in accordance with the quotation and applicable law.
18. Green Waste and Resulting Materials
The quotation should state whether the service includes:
- collection and removal of green waste;
- chipping or shredding on site;
- cutting trunks into specified sizes;
- leaving timber on site;
- stump removal;
- final cleaning of the working area.
Unless expressly stated in the quotation, additional gardening work, earthworks, repairs to paving, complete removal of roots, specialist transport or removal of waste already present before the work began shall not be deemed to be included.
Final cleaning means the reasonable removal of waste resulting directly from the contracted work and does not amount to a complete or landscaping-standard clean of the site.
19. Results of the Work
Crazy Arbor Tree Care will perform the services diligently and in accordance with the technical assessment, accepted quotation, conditions found on site and applicable safety requirements.
Due to the biological nature of trees, a specific response to cutting, pruning, transplanting, treatment or any other intervention cannot be guaranteed unless such a guarantee is expressly provided in writing.
Subsequent growth, the appearance of shoots, leaf fall, changes to the crown, the exposure of previously shaded areas or a reaction to weather conditions do not, in themselves, constitute defects in the service.
Any complaint concerning the performance of the work should be submitted as soon as possible and should include a description and, where appropriate, photographs allowing the situation to be assessed.
20. Limitation of Liability
To the fullest extent permitted by applicable law, Crazy Arbor Tree Care shall not be liable for losses resulting from:
- incorrect or incomplete information provided by the client;
- underground or hidden infrastructure that was not identified;
- internal or root defects that could not be detected through visual assessment;
- subsequent interventions carried out by the client or third parties;
- weather events or natural events occurring after the work;
- pests, diseases or unforeseeable biological changes;
- failure to follow maintenance or safety instructions;
- failure to obtain licences or permissions for which the client is responsible;
- people or animals entering the safety zone;
- delays caused by authorities, suppliers or circumstances of force majeure.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including in cases of wilful misconduct, gross negligence or infringement of mandatory consumer rights.
21. Links to Third-Party Websites
The Website may contain links to third-party websites, social media platforms, maps, messaging services or other platforms.
These links are provided solely to facilitate the user’s access to complementary information or services.
Crazy Arbor Tree Care does not control the content, availability, privacy policies, cookie policies or terms of use of those websites and accepts no responsibility for them.
22. Intellectual Property
Unless otherwise stated, all content made available on the Website, including:
- graphic design;

24. Availability of the Website
Crazy Arbor Tree Care endeavours to ensure the regular availability of the Website.
However, it does not guarantee that the Website will remain continuously available or free from errors.
Interruptions may occur for reasons including:
- maintenance operations;
- technical updates;
- supplier failures;
- electronic communications problems;
- security incidents;
- circumstances of force majeure.
Crazy Arbor Tree Care shall not be liable for losses arising from temporary interruptions to the Website that are not directly attributable to it.

Crazy Arbor Tree Care may amend these Terms and Conditions whenever necessary, including as a result of legislative, technical, commercial or operational changes.
Whenever changes are made, the date shown at the beginning of this document will be updated.
The version applicable to a contracted service will, in principle, be the version in force on the date on which the relevant quotation was accepted, without prejudice to any changes required by law.
30. Governing Law and Jurisdiction
These Terms and Conditions are governed by Portuguese law.
Without prejudice to mandatory consumer protection rules, any dispute arising from the use of the Website or the provision of services shall be submitted to the Portuguese courts with territorial jurisdiction.
31. Alternative Consumer Dispute Resolution
In the event of a consumer dispute, the consumer may refer the matter to an Alternative Consumer Dispute Resolution entity, in accordance with Portuguese Law No. 144/2015 of 8 September, as amended.
The competent entity will depend, among other matters, on the location of the establishment and the nature of the dispute.

33. Final Provision
These Terms and Conditions constitute the general conditions applicable to the use of the Crazy Arbor Tree Care Website.
If any provision is found to be invalid, void or unenforceable, this shall not affect the validity of the remaining provisions, which shall remain in full force and effect.
Failure to enforce any provision of these Terms immediately shall not constitute a waiver of the right to enforce that provision at a later date.
